General Renting Conditions
The ABC Rent A Car (hereinafter:Renter) is letting motorcars for private persons as well as legal entities under the following conditions:
Orders in case of private person are accepted in person, via telephone or telefax.
Minimum renting period 1 day (24hours). Every commenced day is accounted as a full day.
A motorcar can be rented by those:
Verifying their identification by a valid identification card.
Having a determined caution money (credit card, bank transfer or cash)
A rental car can be driven by person:
Having a valid driver's license and adequate practice in car driving (min. 1-years old driving license).
Who completed their 21 year of age.
Whose data are recorded in the rental contract. In case of a legal entity the name of the driver is indicated on the ordering fax.
A rental car may not be:
Sub-rented or borrowed to any other person.
Used for business-like person or cargo transportation, racing.
Carried to a non-permited country.
The lessee agrees:
To use the rented car according to the User's Manual of the car rented and, to obey the specifications of the Highway Code. For any damage originating from disobeyance to this the Lessee is bearing a full-scale financial responsability. The Lessee receives the car with fully filled fuel tank and he is obliged to returning the car, then an extra cost will be charged by the Renter for the cost of the subsequently filled fuel.
Only a fuel of specified quality may be filled into the car by the Lessee is bearing a full-scale financial responsablity.
The Lessee is obliged to pay the parking, ferry and other charges during the entire rental period. In case the Rental fails to buy the relevant ticket (eg.: in a paying parking place) and the vehicle owner (ABC Rent A Car) receives any police report/demand than ABC Rent A Car will charge the Renter's credit card for the amount due without any further notice.
Please note that these charges may occur at a later date after the rental has been closed. Additional administration fee will be charged upon fine by ABC Rent A Car.
ABC Rent A Car ensure all vehicles are provided with Romanian highway stickers. For a compolsury daily fee we will take full responsability for paying the highway toll fees and carry out all administration for the payments.
In case of an irreparable failure the request for rescuing or replacement of the car has to be announced by phone.
In case of accidents the Lessee is obliged to ask measures by the Police and notice the Renter about the event within 24 hours. If the car is opened by force, damaged or stolen then Lessee is obliged to report the event to the competent Police Station and to deliver the deed of this to the Renter. Furthermore, the Lessee has no right to make any agreement and he/she may not issue any declaration an grievance of the Renter.
If the accident has occurred due to a reason other than fault of the Lessee but the Lessee is unable to verify this with adequate documents (license-insert from the driver causing the accident confessing his guiltness. or police certification) then the accident has to be considered as one caused by fault of the Lessee and the expenses originating from this will be born by the Lessee.
In case of own-fault accidents the Rental is not obliged to provide a replacement car. In case of eventual stealing of the car the Lessee is obliged to return the following things to the Renter: starter key, alarm switch, immobilizer code key, vehicle license, rental contract. If the Lessee is incapable of returning anyone of the above said things then he/she is responsable up to the total value of the car, independent of the insurance requested.
Each damage event occuring due to carelessness of the Lessee will be charged to his/her debit.
The Lessee is obliged to pay for the accessories lost, if any.
Should the vehicle be returned outside the working hours of the Renter or at a location at wich there is no ABC Rent A Car representative office, the Lessee shall be liable for all damage ocurring prior ro the actual handover of the vehicle to an employee of the Owner.
Should the car be returned at a place and time other than indicated in the rental contract the tariff stated in the contract is not valid and the incurring additional costs will be charged to the Lessee.
The hirer takes notice of that fact, that he can not take the car to the countries, designated in the contract for hiring. In that case if the hirer violate or try to violate this prohibition, then the hirer-out is authorised to terminate the contract with the hirer with immediate effect and take the car back from the hirer.
For the cars rented at Henri Coanda and Aurel Vlaicu Bucharest Airports, an airport duty will be charged.
Conditions of insurance relating to the car:
The insurance does not cover the wheel, tyre and passenger compartment damages or damaging caused the roof of the car and to damages occuring below the threshold line.
In case of basic damage insurance policy rate of the own-part is 10% but minimum 400 EUR (or the sum that equals in RON).
In case of insurance against stealing with partial own-part payment (TW) the rate of the own-part is 400 EUR (or the sum that equals in RON).
In the following cases the Lessee is obliged to reimburse the total damage value:
If the car was driven by a person other than indicated in the rental contract or in the appendix thereof.
If the damage has occured during tractioning of another vehicle.
In the car was driven under alcoholic or drug influence.
Incase of any damage if it has occured on area of a non-licensed country.
All charges and fees listed in the General Renting Conditions are final (all taxes included).
